How to: perform a balancing test

How To
  1. Go Privacy Management > Legal Management.
  2. Click ‘Add balancing test’.

Identifying Legitimate Interest

  1. Select the Related personal data processing activity from the ‘Related Personal Data Processing Activity’ list.
  2. Indicate the importance of this processing activity from the ‘Importance of this Processing Activity’ list.
  3. Select the most appropriate answer: Can the intended Processing Activity be carried out based on another Legal Ground other than Legitimate Interest? 
  4. Provide a description to provide more detail in the ‘Description’ field.
  5. If applicable, select the other legal basis possible from the list.
  6. Select if the Processing Activity is necessary for one or more organisational purposes.
  7. Provide a description to provide more detail in the ‘Description’ field.
  8. Select if the Processing Activity is necessary for one or more organisational purposes of a Third Party.
  9. Provide a description to provide more detail in the ‘Description’ field.
  10. Provide more information about the third party in the ‘Third Party Description’ field.
  11. Select if there is an allowed exception in the law, recitals, guidelines, advises or opinions.
  12. If yes, select the exception from the ‘Exception’ list.
  13. Create a review interval by entering a review interval number and selecting a review interval period (day/week/month/ day(s)/week(s)/month(s)).
  14. Click ‘Next’.

Scope Definition

  1. Select the frequency of interactions between the organization and the individual whose personal data are being processed from the list.
  2. Select what the relationship us between the individual whose personal data are being processed and the organization from the list.
  3. Select if the personal data has been obtained directly or indirectly from the individual from the list.
  4. Select who has the data subject been informed about the processing activity. Choose the most appropriate answer from the list.
  5. Select if the data subjects involved can easily exercise their right to object from the list.
  6. Click ‘Next’.

Balance of Interest

  1. Select for each question an answer from the list.
  2. Click ‘Next’.

Conclusion

  1. RESPONSUM will provide you a calculated result. The result calculated is based on a generally defined weight linked to the questions you answered earlier in the Balancing test.
  2. The responsible person can make a final decision by selecting yes or no from the list and providing a justification in the description field.
  3. Click ‘save’
